Terms of Service

1.1. Age Requirement. You must be at least 13 years old to use the Service. If you are under the age of 13, you may not use the Service. We do not knowingly collect personal information from children under 13; if we learn we have done so, we will delete that information.

1.2. Account Responsibility. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

2.1. You Own Your Content. You retain all ownership rights to the documents, notes, and other content you upload to the Service ("User Content").

2.2. Your Warranty to Us. By uploading User Content, you represent and warrant that you own the content or have all necessary rights to grant us the license below, and that your content does not infringe on any third party's rights.

2.3. Our License to Your Content. To allow us to operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, create derivative works of (such as our AI analysis), and process your User Content solely for the purpose of providing, improving, and protecting our Services for you.

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act ("DMCA"). We will respond to valid notices of alleged copyright infringement.

We have a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.

If you believe your copyright has been infringed, please send a DMCA Takedown Notice to our Designated Copyright Agent at: dmca@mytome.com.

Our service provides access to certain books that are in the public domain in the United States. These works are provided free of charge and may be freely copied, distributed, and used.

If you are accessing the app from outside the United States, you are responsible for checking whether a particular work is in the public domain in your country before downloading or using it.

We do not claim copyright ownership of public domain works. Sources for some of these texts include publicly available archives such as Project Gutenberg (www.gutenberg.org), OpenStax (openstax.org), and LibreTexts (libretexts.org). We are not affiliated with or endorsed by Project Gutenberg, OpenStax, or LibreTexts.

5.1. AI Content Disclaimers. Our AI features are provided "as is" for educational purposes only. While we strive for accuracy and implement content safeguards, we do not guarantee that any AI-generated content or analysis will be error-free, complete, appropriate, or free from bias, misinformation, or harmful content. AI systems may occasionally produce outputs that are inappropriate, offensive, inaccurate, or potentially harmful.

5.2. User Responsibility. You are solely responsible for reviewing, evaluating, and determining the appropriateness of any AI-generated content before using, sharing, or relying on it. You acknowledge that AI outputs should be used as educational assistance tools only and should not replace human judgment, professional advice, or critical thinking.

5.3. Content Filtering Limitations. While we employ various measures to filter and moderate AI-generated content, no automated system is perfect. We cannot and do not guarantee that all inappropriate, harmful, or offensive content will be prevented or detected.

5.4. No Liability for AI Content. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR ANY HARM, DAMAGES, OR LOSSES ARISING FROM AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO CONTENT THAT IS INACCURATE, BIASED, OFFENSIVE, OR HARMFUL. You agree to hold us harmless from any claims related to your use of or reliance on AI-generated content.

5.5. Reporting. If you encounter AI-generated content that you believe is harmful, inappropriate, or violates these Terms, please report it to us at support@mytome.com so we can improve our systems.

11.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

11.2. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in English in Delaware, unless both parties agree to a different location.

11.3. Class Action Waiver. You and we agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

11.4. Exceptions. Either party may seek injunctive or other equitable relief from any court of competent jurisdiction to protect its intellectual property rights or confidential information. Additionally, you may bring claims in small claims court if they qualify.

11.5. Costs. Each party shall bear its own costs and attorneys' fees in any arbitration, except that the arbitrator may award fees and costs to the prevailing party if permitted by applicable law.
